This episode discusses the U.S. Department of Labor’s recent decision to withdraw agency guidance on independent contractors in June 2017. It also addresses relevant case law from 2010 and 2015 in which courts held that staffing agencies in the health care industry were liable for unpaid wages, interest and penalties because certain nurses were deemed to be employees, rather than independent contractors, of such agencies. The episode also provides some practical considerations for organizations determining whether to maintain independent contractor relationships in light of the current legal and regulatory framework.
