This is the first segment in a three-part series about the fundamentals of Payer-Provider Litigation. It explains that in-network providers are required to challenge reimbursement decisions under contract law and state law, while out-of-network providers are increasingly required to bring claims under the Employee Retirement Income Security Act of 1974 (“ERISA”).
