In the second episode of our series on the national opioid crisis, Gina Bertolini discusses the overlay of recent guidance concerning privacy laws such as the Health Insurance Portability and Accountability Act (HIPAA) and the Confidentiality of Substance Use Disorder Patient Records (Part 2) regulations and how they are interpreted with regard to opioid treatment. While the HIPAA Privacy Rule generally restricts the sharing of patient information, there are certain circumstances particularly relevant in the drug overdose and treatment context that allow for permissive disclosure without prior authorization.
